Terms and conditions
1. About these terms
These terms are between you and kitfit, of 8-12 Alder Hills, Poole, BH12 4AL. kitfit is in research and development and isn't trading yet; once it is, the party to these terms will be [the legal entity, once registered].
They cover using kitfit's website and its service, whether you use them yourself or through an AI assistant acting for you, and buying from kitfit. Please read them; your AI can read them too, at /terms.md.
"You" is the person kitfit's service is used for. "Your AI" is any AI assistant, agent or software you use to work with kitfit.
2. While kitfit is in testing
- kitfit is in research and development. Its service is open by invitation only, and nothing is sold: nothing ordered during testing is made, sent or charged.
- Your invitation link carries a key that is yours alone. Don't share it; kitfit can withdraw it at any time.
- kitfit may change, pause or stop the test service at any time.
- What you send kitfit during testing, including the chat logs and feedback you upload, is used to improve kitfit, as set out in the privacy notice.
3. Using kitfit through your AI
- You may use kitfit through any AI assistant. Your AI acts for you: what it sends kitfit for you, and the choices it confirms, are treated as yours.
- You vouch for what your AI sends: your measurements, your layout and your details. Make sure it is right, and that you may share anyone else's details it includes.
- kitfit's own word is in its replies, drawings, quotes and payment page. Your AI's summary of them may be wrong or incomplete: check kitfit's drawings and quote before you pay.
- An order is only ever made by you, on kitfit's payment page (section 6). An AI cannot place an order or pay.
- Don't use kitfit, or have an AI use it, to overload or attack the service, to get at other people's data, to send personal data you have no right to share, or for anything unlawful. kitfit may suspend access that does.
4. Your measurements and the fit
kitfit makes every part to the layout and room you sign off. Where the measurements are yours, you vouch for them and the fit depends on them: filler strips come oversize, to cut to fit on site. kitfit guarantees the fit only where the room was measured by kitfit's own scan, on the terms given in writing with the order.
5. Quotes and prices
- A quote is not an offer you must accept, and holds for [quote validity period].
- Prices to consumers include VAT and every compulsory charge. Delivery is shown before you pay.
- If a price is plainly wrong, kitfit tells you before going ahead, and you can cancel.
6. How an order is made
- Your AI sends kitfit your layout and the room.
- kitfit checks them and, from tape-measure figures, draws the room for you to sign off.
- kitfit quotes. Where a person must check something, kitfit's team confirms the price first.
- Your AI gives you a link to kitfit's payment page. Until you pay you can change anything, through your AI, and see the drawings and quote again.
- When you pay on that page, you accept these terms and the order is made. kitfit confirms it to you in writing, and keeps a copy of the order, which you can ask for.
The contract is in English.
7. Delivery
kitfit tells you the delivery date and charge before you pay. In Dorset, Hampshire (including the Isle of Wight) and London delivery can be part of the quoted price; elsewhere kitfit's team arranges it. Where no date is agreed, kitfit delivers within 30 days of the order. The kit is yours, and at your risk, once it is delivered to you.
8. Cancelling
- Made-to-measure parts are made to your specifications, so the 14-day right to cancel an online order does not apply to them.
- Standard items supplied unaltered can be cancelled within 14 days of delivery, without a reason: tell kitfit, return them unused within 14 days, and kitfit refunds you, including the standard delivery charge for them, within 14 days of receiving them. You pay the cost of returning them unless they are faulty or not as described.
9. If something is wrong
The law requires what kitfit supplies to be of satisfactory quality, fit for purpose and as described, and kitfit's services to be carried out with reasonable care and skill. If it isn't, you can reject the goods within 30 days of delivery for a full refund, or ask for a repair or replacement, and if that fails, a price reduction or refund. Nothing in these terms affects those rights. Tell kitfit straight away: see complaints.
10. Business customers
If you buy for a business, sections 8 and 9 do not apply to you as written, and [the business terms: warranties, limits of liability and payment terms].
11. Liability
kitfit is responsible for loss you suffer that was foreseeable as a result of kitfit breaking these terms or failing to use reasonable care and skill. It is not responsible for loss that was not foreseeable, for loss caused by measurements or information you or your AI gave, or for the work of anyone who assembles or fits the kit. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
12. Drawings and files
kitfit's website, drawings, templates and instructions are kitfit's. Those made for your project are yours to use for that project.
13. Changes, law and disputes
- kitfit may update these terms; the version on the day you order applies to that order.
- These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your own courts.
